Welcome to GUIDEASY. These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, accessing, or using the GUIDEASY Service, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

You must be at least 13 years old to use our Service. If you are under 18, you must have permission from a parent or guardian. By using the Service, you represent and warrant that you meet these requirements.

GUIDEASY name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GUIDEASY or its affiliates. You may not use such marks without our prior written permission.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by GUIDEASY. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
  • WARRANTIES REGARDING AVAILABILITY, RELIABILITY, OR ACCURACY
  • WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE

We do not guarantee the accuracy, completeness, or usefulness of any information on the Service. Any reliance on such information is at your own risk.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GUIDEASY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • LOSS OF PROFITS, REVENUE, DATA, OR USE
  • DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE SERVICE
  • DAMAGES ARISING FROM THIRD-PARTY SERVICES OR CONTENT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless GUIDEASY and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another
  • Your User Content

12. Dispute Resolution

12.1 Informal Resolution

12.2 Arbitration

If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

You agree to bring claims against us only in your individual capacity and not as part of any class or representative action.

  • Your account has been inactive for an extended period
  • We decide to discontinue the Service

The Service is provided from the United States. We make no claims that the Service is accessible or appropriate outside of the United States. Access to the Service may not be legal in certain countries. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

22. Additional Terms for Mobile App

If you access the Service through a mobile application:

  • You agree to comply with the terms of the app store from which you downloaded the app
  • Your use of the app may be subject to the app store's terms and conditions
  • The app store and its subsidiaries are third-party beneficiaries of these Terms
  • We, not the app store, are solely responsible for the app and its content

BY USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
